APPLICATION FOR GRANT OF EXEMPTION

 An "Application for Grant of Exemption" is submitted in court to seek permission from the court to be excused from fulfilling a specific procedural requirement or legal obligation under certain circumstances. It is generally filed by a party (or their lawyer) when compliance with a rule or order is not possible or practical.

Common Reasons for Filing an Application for Exemption:

  1. Exemption from Personal Appearance

    • If a party (especially the accused in criminal cases or a witness) is unable to attend court due to illness, distance, age, or other valid reasons.

  2. Exemption from Filing Original Documents

    • If a party wishes to file photocopies instead of original documents due to unavailability or risk of loss/damage.

  3. Exemption from Court Fee

    • Poor litigants (indigent persons) may seek exemption from paying court fees under Order XXXIII of CPC (civil cases).

  4. Exemption from Delay

    • If there is a delay in filing a case or document, exemption may be sought under Section 5 of the Limitation Act.

  5. Exemption from Specific Procedural Requirements

    • Such as skipping a particular step in procedure due to justified reasons.

APPLICATION FOR GRANT OF EXEMPTION FROM PERSONAL APPEARANCE TO APPELLANT NO.1 & 2

That the appellant most humbly submit as under:-

  • That the present matter is fixed for argument before this Hon’ble Court.

  • That the appellant no.1 is out of station for some urgent purpose and appellant no.2 is suffering from viral fever and hence both the appellants are unable to appear before this Hon’ble court on today’s date.

  • That in view of the above this Hon’ble Court be pleased to grant exemption from personal appearance to the appellants in the interest of natural justice.

PRAYER It is therefore prayed that this Hon’ble Court be pleased to grant personal exemption to the appellant in the interest of natural justice.
